Absolute Chilled Shop is a business in the airconditioning industry that sells airconditioners and heatpumps as well as services relating to these products via our online store.

2. Delivery policy

Subject to availability and receipt of payment, requests will be processed within 2 working days and delivery confirmed by way of e-mail/telephonic confirmation by the Absolute Chilled team using your generated order number as a reference. Standard delivery takes place 1-4 working days from date of payment. Free delivery to major metropolitan areas within South Africa only. For outlying area deliveries please contact the Absolute Chilled offices to assist in providing a delivery pricing calculation. Please refer to our contact information for more details.

3. Export restriction

The offering on this website is available to South African clients only.

4. Return and Refunds policy

The provision of goods and services by Absolute Chilled Shop is subject to availability. In cases of unavailability, Absolute Chilled Shop will refund the client in full within 30 days. Cancellation of orders by the client will attract a 5% administration fee.

Our Samsung and Alliance aircon products cover a 5 year warranty period provided that the unit is installed by an installation company authorised by Absolute Chilled Shop, the unit is serviced as per the warranty card guidelines; and the customer registers their product on www.fourwaysaircon.co.za or www.allianceair.co.za. All other warranties are as stipulated on the Absolute Chilled Shop website.

5. Customer Privacy policy

Absolute Chilled Shop shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from www.polity.org.

6. Payment options accepted

Payment may be made via Visa or MasterCard cards and will be facilitated via PayGate online payment solutions.

7. Card acquiring and security

Card transactions will be acquired for Absolute Chilled Shop via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

8. Customer details separate from card details

Customer details will be stored by Absolute Chilled Shop separately from card details which are entered by the client on DPO PayGate’s secure site. All details stored by Absolute Chilled Shop will be secured via Secure Socket Layer (SSL) transport encryption and stored in a secure fashion. 9. Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

10. Responsibility

Absolute Chilled Shop takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

  1. Absolute Solar solutions (“Absolute Solar”) is committed to complying with the letter and spirit of the Consumer Protection Act 68 of 2008.
  2. Quotations shall lapse after 7 days unless expressly stated otherwise in writing, where after they shall be subject to review at the discretion of Absolute Solar.
  3. Absolute Solar shall be entitled to withdraw or amend a quotation at any time prior to acceptance by the Customer, by communicating this to the Customer in writing.
  4. Upon signature of a quotation or confirmation via e-mail, it becomes binding on the Customer and the Customer cannot cancel except with the express written consent from Absolute Solar.
  5. The deposit as stipulated on the quotation is due, owing and payable on acceptance of the quotation. Procurement of equipment and installation will not commence until such deposit as well as this document, duly signed, has been received by Absolute Solar.
  6. Where an ongoing service component is included in the solution a signed service agreement must be returned to Absolute Solar prior to installation of the system.
  7. Should the deposit remain unpaid after 7 (seven) days from the acceptance of quotation, Absolute solar may at its sole discretion cancel the agreement.
  8. Where the installation is completed in phases, progress payments shall be payable on presentation of a Progress Payment Schedule for work completed.
  9. The final balance is due, owing and payable on invoice, which shall follow commissioning of the equipment. In the event that Absolute Solar is prevented from commissioning the equipment due to factors relating to access to or readiness of the installation site, and all equipment has been installed, the final invoice shall be submitted, and commissioning and handover performed once it becomes possible to do so.
  10. The Customer may not withhold payment for any reason whatsoever, notwithstanding any counter-claim which may accrue in favour of the Customer against Absolute Solar.
  11. Absolute Solar does not consent to any retention being held by the Customer nor to any terms of deferred payment.
  12. Each separate area of the installation and each installation itself may, at the sole option of Absolute Solar, be regarded as divisible or alternatively inseparable from the main contract, as Absolute Solar shall choose and the Customer shall in either event not be entitled to defer or hold payment in respect of any installation completed by Absolute Solar nor shall partial payment discharge the customer from liability for so much of the contract as has been performed by Absolute Solar.
  13. Amounts remaining unpaid after 7 days of invoice shall accrue interest at a rate of 2% per month, as provided for by the National Credit Act No34 of 2005.
  14. In instances where approval is required from Body Corporate, Home Owner’s Associations, Electricity Service Providers, Municipalities, etc, Absolute Solar shall assist with such applications as far as practically possible.
  1. The Customer shall be responsible for all additional costs relating to the approval of such systems, including but not limited to the preparation of documents, Professional Engineer’s sign-off, attendance at system inspection and testing meetings with the approving body, etc., where these have not been expressly included in the system quotation.
  2. Absolute Solar shall not be liable for any delays arising from any approval process, and the Customer agrees that payment in full for the system shall not be delayed nor withheld as a result of delays with such processes.
  3. As solar and battery power systems take many forms and offer a range of performance capabilities, Absolute Solar undertakes to provide clear, honest and accurate information to the Customer regarding the functionality and performance of the system(s) offered, and warrants that its representatives possess the relevant expertise in this regard. The Customer confirms by acceptance of a quotation that the system specification meets their requirements, and that all defining characteristics have been reduced to writing.
  4. Quotations are based on the information supplied by the Customer, except where otherwise specifically determined by Absolute Solar.
  5. Site inspections performed by Absolute Solar Sales Consultants do not include on-roof or in-roof inspections, inspection of distribution board wiring, etc.
  6. The price quoted and the acceptance of any quotation is based on the presumption that the existing electrical installation on the premises is in good order and compliant with prevailing regulations, legislation and good electrical practice.
  7. Many of the inverter systems supplied by Absolute Solar incorporate internal ground fault detection devices, as a compulsory element of their certification to South African safety standards. This may expose pre-existing ground faults in the building’s electrical system, particularly on circuits which were not previously protected by an Earth Leakage unit. The tracing and resolution of such ground faults is not included in the system quotation.  The customer may choose to have the affected circuits left off the backup, or to authorise Absolute Solar to rectify the faults.
  8. Absolute Solar will not be held liable to ensure that any roof structures are strong enough to hold the weight of the panels. It’s the customers own responsibility to ensure that any roof is reinforced enough to hold the weight of the recommended amount of panels.
  9. Any additional work necessary to execute the installation shall be at the Customer’s risk and at the Customer’s expense. Such work shall be agreed in advance with the Customer as it is identified.
  10. Any variations or alterations to the scope of work done or any extras required by the Customer will be for the Customer’s account.
  1. The Customer may elect to appoint a third party to perform the additional work identified in Clauses 22 and 23 above, subject to Clauses 299, 31 and 32 below.

25.1 Should any additional equipment (eg. Batteries, Panels and additional inverter) be installed by another Solar Company, to the original system that was installed by Absolute Solar, the warranty that Absolute Solar carries will become null in void with immediate effect.

  1. Absolute Solar may substitute any component of the installation with another of equivalent or better quality and/or specification after consultation with an agreement by the Customer, and such agreement shall not be unreasonably withheld.
  2. Any extra amounts which may become due and payable in terms of this agreement, over and above the contract price, are due and payable on demand. Absolute Solar reserves the right to suspend the performance of this contract until such amounts are paid in full.
  3. Installations shall be scheduled subject to the availability of equipment and installation capacity.
  4. Installations are scheduled during normal working hours (Mondays to Fridays between 8:00am and 5:00pm). Should the Customer require installation to take place outside of these times, or should the site not be available or accessible for the full working day necessitating the work to be completed over a number of days, an extra charge shall be payable.
  5. The Customer agrees that time is not of the essence to this contract and no delivery or installation date is guaranteed, unless expressly stated in writing in the quotation.
  6. Should the Customer require the installation to be rescheduled, a minimum of 24 hours’ notice shall be given.
  7. Should the Customer fail to provide such notice, and Absolute Solar is unable to perform the installation as scheduled, Absolute Solar shall be entitled to levy a cancellation fee for travel and productivity costs incurred.
  8. It is a condition of this contract that free and easy access to the site of the installation must be made and arranged beforehand by the Customer. Absolute Solar may levy a fee for lost time as a result of excessive access delays.
  9. The Customer undertakes to ensure a free supply of reliable electricity to Absolute Solar in order to enable the contract to be executed. It is the responsibility of the Customer to advise Absolute Solar of the non-availability of electrical power, who may at its sole discretion elect to continue with the installation in part or in full by making its own provision for electrical power, and to charge a reasonable fee for the provision of such power.
  10. The commissioning of systems requires the availability of the relevant electrical supply and access to the Customer’s WiFi or an Ethernet point if applicable. Should commissioning not be possible due to the non-availability of the above, a fee shall be levied by Absolute Solar to return and commission the system at a later date.
  11. The remote monitoring and control of the power system purchased may depend on a stable internet connection. The Customer shall be responsible for ensuring the strength and stability of this connection, and for any network maintenance upgrades required in this regard.
  12. A Supplementary Electrical Certificate of Compliance (CoC) shall be issued for the work performed by Absolute Solar. It is a legal requirement that the Supplementary Electrical CoC references the serial number of the original Electrical CoC of the building. The Supplementary Electrical CoC shall only be issued once Absolute Solar has received a copy of the building Electrical CoC.
  13. The Customer shall be entitled to receive a handover of the system. Where a customer requests this handover to take place outside of normal working hours (Mondays to Fridays between 8:00am and 5:00pm) an additional charge shall be payable.
  14. Risk in respect of the equipment shall transfer to the Customer on delivery to the installation site. Any equipment delivered but not installed shall be appropriately stored and secured in consultation with the Customer.
  15. Absolute Solar shall be responsible for any loss or damage to equipment during installation or commissioning, except where such loss is directly attributable to a third party or where interference with the system by an unauthorised person has caused the fault or defect.
  16. Absolute Solar accepts no responsibility for damage to system components as a result of extended interruptions to the electricity supply after commissioning. Damages of this nature are excluded from any warranties provided.
  17. The components and products supplied and installed by Absolute Solar are warranted by the manufacturers and importers thereof, and Absolute Solar shall facilitate the claims against such warranties where required. Where such warranties are of a limited nature, any costs incurred by Absolute Solar by way of testing, removal, delivery, collection and reinstallation of the affected component or equipment, shall be for the Customer’s account.
  18. Absolute Solar bears no responsibility for delays or losses arising from matters beyond its control which without derogating from the generality of the foregoing, include acts of God.

SOLAR SYSTEM AND PANELS MUST BE SERVICED ANNUALLY

  1. Absolute Solar’s liability for damages arising out of defective materials or workmanship is limited to the provisions of Section 61 of the Consumer Protection Act.
  2. All complaints concerning the installation, the work or the material must be made in writing to Absolute Solar within 21 days of Absolute solar leaving the site, failing which no claim will be recognized thereafter. Please note: Faulty equipment will need to be tested by the manufacturer. This may take up to 14 working days. A loan unit will be supplied, if possible, but this can NOT be guaranteed.
  3. All indications of system performance provided by Absolute Solar are as a far as is practical based on scientific principles and include manufacturer’s specifications and international solar radiation databases. As many of the factors determining system performance (weather, usage patterns, etc) are beyond the control of Absolute Solar, no warranties of solar performance are made unless expressly provided for in writing.
  4. The Customer consents to the jurisdiction of the Magistrate’s Court in respect of all claims arising out of this contract.
  5. The rights arising out of this agreement may be ceded by Absolute Solar without notice to the customer.
  6. This form together with the quotation constitute the full terms of the contract between Absolute Solar and the Customer and no alterations or variations to this contract will be recognized unless in writing and signed by Absolute Solar.
  7. WARNING
    • Certain of the Goods sold may, by its very nature, cause serious injury or death if not correctly used. It is therefore imperative that the operating manual and/or directions of use as provided by the manufacturer and/or the Company be strictly followed and adhered to. 
    • It is the duty of the Customer to ensure that he is in possession of the applicable operating manual and/or directions of use.
